“Managers have a solution for every problem. Officials have problems with every solution” – these words of distinguished German lawyer Guenter Hartkopf concisely define the aversion of fiscal administration towards propositions aimed at introducing order into tax law.
The newest “achievement” of the tax authorities in this regard is the inconceivable and absurd opposition to introducing the in dubio pro tributario principle, as suggested by President Komorowski. The Ministry of Finance started attacking the draft immediately after it was made public. – The principle is not formulated clearly and it does not appropriately express the statutory interpretation, so it may cause serious disagreements as to how to interpret and apply it – stated Viceminister of Finance Janusz Cichoń in an interview with “Puls Biznesu”, while at the same time declaring his support for the presidential initiative – which appears to be a contradiction.
