Due to unclear regulations, employers are required to archive all documents pertaining to employment and contractors.
This is what is shown by a letter from ZUS received by Employers of Poland. The employers’ organization asked ZUS for an interpretation of art. 125a paragraph 4 of the FUS pension act.
– It is not good when a regulation which has been in force for 17 years is so vague as to allow such an interpretation. This will be a surprise for many – says Witold Polkowski, expert of Employers of Poland. – Most accountants destroy such documents after ten years. Now it transpires that it is better to keep them forever. The letter from ZUS shows one other thing as well: this obligation applies to all contribution payers. Thus, if someone legally employs, say, a household help on contract of order, he should keep all related documents for 50 years.
