Companies with employees on contracts of employment are still losing tenders.
The newest report of the CSR Centre monitoring tenders shows that officials have found a way to circumvent the public procurement law – the regulation in question states that criteria other than the price should be applied to tenders.
– The lowest price criterion is the most convenient for the contracting entities – comments Jakub Pawelec of the Mazurek and Partners Legal Office, expert of Employers of Poland. – The question is whether the cheapest offer is the best. The companies who lose tenders to companies which have flagrantly undervalued their offers, can and should appeal.
