Adam Bodnar, the Human Rights Defender, will check how the tax authorities practically apply the in dubio pro tributario principle.
First, in December 2015, a seminar will be held at the Defender’s office, then a team of tax experts will be appointed, in late 2016 a handbook for entrepreneurs will be published. Later, the Defender will check whether the tax authorities really do resolve all legal ambiguities in favour of the taxpayers. Such is the plan outlined by Adam Bodnar.
President of Employers of Poland Andrzej Malinowski, initiator of the “Wyrwij fiskusowi bat” (“Do not let the tax authorities bully you”) campaign, compliments the initiative.
— I am very happy that the Human Rights Defender wants to take a closer look on the practical application of the in dubio pro tributario principle. The formulation of it is indeed ambiguous, as pointed out by experts. Under the Defender’s auspices, tax expert should look at the actions of the tax authorities. If it is shown that the regulation does not bring the desired effects, it should be fixed — says Andrzej Malinowski.
