If ZUS uncovers many years later that it granted a pension based on a false work certificate, it may demand the undue pensions back.
Doubts were raise by the case of an ex-employee who has been on early pension starting in 1992. When in 2002 she applied for the benefit to be recalculated, it was revealed that the work certificate she presented many years ago had very mistakes in it. The food cooperative which employed her calculated her employment period without interruptions.
– Employers do not pay sufficient attention to work certificates, as shown by statistics of the National Labour Inspectorate – comments Witold Polkowski, expert of Employers of Poland. – However, they should, as they are fully responsible for any mistakes found in these certificates. Moreover, the period of limitation of ZUS’ claims for pension returns is calculated starting on the day when the irregularities are uncovered, although they may have taken place many years before – he adds.
