At present employers  learn about changes in the law mainly from mass media or simply through the grapevine, usually with delay.

“Rzeczpospolita”: After amendments, there will be fines for contractors


After January 1st 2016, employees on contracts of order will have to pay companies to cover outstanding ZUS contributions and interest rates.


After an article on contributions on contracts of order published on December 18th 2015, “Rzeczpospolita” has received a press release of the Ministry of Family, Labour and Social Policy important for over 700 000 employers who employ contactors.


It indicates that starting on January 1st 2016, contracts of orders should include clauses making the  contractors liable for misrepresentation. This applies to cases when a contractor works for several companies. Starting on New Year, all companies employing contractors are obliged to pay ZUS contributions for subsequent contracts with them until they accumulate to a level corresponding with the minimum wage (1850 PLN in 2016). If the contractor provides false information on wages in other companies, entrepreneurs will have to correct the documents submitted to ZUS and pay additional interest on rates paid after the deadline.


– Regulations should not create a conflict between the employer and the contractor, and in this case everything indicates that this is indeed the case – comments Witold Polkowski, expert of Employers of Poland. – Furthermore. entrepreneurs will have serious problems implementing the new regulations – he adds.
