Company owners would like to receive interpretations of regulation on all issues – not only on taxation. The Ministry of Economy does not say no.
Interpretations of the law, provided at an entrepreneur’s individual request should be issued in many cases related to conducting economic activity. Employers of Poland and PGNiG postulate including such a possibility through a regulation, preferably in the new Economic Activity Act. The draft of this act involves maintaining the regulations currently in force in terms of interpretations which employers can request.
According to Employers of Poland, this is not enough. They emphasize that there are many other ambiguous regulations pertaining to economic activity which include a penalty in case of a failure to conform.
Employers of Poland are of the opinion that the opportunity to get an administrative interpretation of laws related to obligations which include penalties or to prohibition which involve – even facultatively – administrative sanctions.
– Such a solution will ensure greater effectiveness of regulations, a s more entrepreneurs will know how to apply them properly – prognoses Andrzej Malinowski, President of Employers of Poland.
The organization suggests that such interpretations should be binding and that the applicants should be allowed to present their own assessment of the application of regulations in a particular situation.
As of now, the fate of employers’ propositions is undecided, but the Ministry of Economy did not reject them and considers them a topic for discussion.
