Monty Python once did a famous sketch about the Ministry of Silly Walks, admittedly a very funny one. Sadly, it appears that similar offices – many of them – are needed in Polish administration, which is not as funny… The Department of Seashores should be the first to established in order to protect Polish companies from destruction at the hands of the tax authorities – President of Employers of Poland Andrzej Malinowski writes in “Rzeczpospolita”.
– The consequences of a lack of a million separate departments dealing with a million small issues are grave, and entrepreneurs who believed in the government’s seashore protection felt them the most – he adds.
Companies carrying out procurements related to the program were to be exempt from VAT. Marine offices encouraged them to participate, claiming that contractors would not pay tax, as the works constituted “marine environment protection”.
– Years later, the tax authorities returned to the issue and concluded that VAT should be paid after all! 23 percent plus outstanding interest, which could be the end of many companies. Why so much? The seashore is not a marine environment. That is an interesting justification, to put it mildly. Yet again the tax authorities trumped the simpletons who still believe in the consistent interpretation of tax law and the state governed by the law – remarks the President of Employers of Poland.
Malinowski adds that the explanation provided by the Ministry of Finance is rather ludicrous: the Ministry says it has no Department of Seashores. – Compared to this, Monty Python is an amateur troupe, they have nothing on the professionals in the Ministry of Finance! Next time when similar works are contracted a small provision should be included by way of decency: “The ordering party does not guaranteed that it will not lie to the contractor and extort VAT from him due to eg. the lack of an appropriate department”. However, if that should happen, many Polish beaches will become a part of the marine environment anyway, destroyed or flooded by the Baltic Sea: like many companies who once trusted a public procuring party – summarizes the President of Employers of Poland.
