"Rzeczpospolita": Who will give companies a second chance?


Sejm passed the new restructuring law for companies. With a mistake – warn experts.

The new law is intended to change the approach to companies who find themselves in serious financial trouble. Instead of going bankrupt, they will be given a second chance. – In the case of the Restructuring Law passed on April 9th, we are dealing with a good reform, unanimously accepted by experts – says Arkadiusz Pączka, director of the Legislation Monitoring Centre of Emloyers of Poland. –  Sadly, due to a curious resistance on the part of the government, which appears to be determined to destroy its own reforms due to budgetary savings – he warns.

The crux of the matter is the question which courts –  regional or local should conduct restructuring procedures.–  Using budgetary savings as an excuse seems laughable when the result might be that the a good and eagerly awaited reform amounts to nothing. However, the government seems intent to destroy its own initiative – comments Pączka.
