According to the experts of the Employers of  Poland, the judgment of the Tribunal of Justice of the European Union concerning among others the coordination of insolvency proceedings may result in a consistent interpretation of the current rules in this regard.


The experts of the Employers of Poland emphasize that today there is no consistent regulation forming insolvency processes at the EU level. The Judgment of the Tribunal of Justice may be the clue to the interpretation of the relevant provisions.


The revision of the directive concerning the insolvency proceedings arises due to the need for adjusting it to the dynamic changes taking place on the market, harmonizing legislation of particular countries in this respect, and due to the high frequency of changes in national legislation, which hampers the implementation of cross-border insolvency proceedings.
