In Poland there is neither an internet portal nor an institution for employers responsible for monitoring the legislation process of regulations that determine the rules for business activity. At present employers  learn about changes in the law mainly from mass media or simply through the grapevine, usually with delay.

The Employers of Poland have summarized the year 2012

The Employers of Poland in the forecasts for 2012 emphasized that maintaining relatively good macroeconomic indicators would be possible on condition that some changes in the legal environment of business were introduced, which would increase the competitiveness of our economy. The demand of the Organization was not met, which -combined with the unfavourable situation in the external environment - resulted in poor economic performance.

 

THE SUMMARY OF 2012 BY THE EMPLOYERS OF POLAND

 

INVESTMENTS AND ENTREPRENEURSHIP

Advantages:

  • The passage of the act on reduction of some administrative charges in the economy (the so-called third deregulation law).

 

Disadvantages:

  • The increase in pension contribution on the side of the employer, failure to reform public finances - the lack of will to review the expenditure side of the budget and to reduce unnecessary commitments.

 

 

THE JUDICIARY

Advantages:

  • The draft of guidelines of a bill on amendment to the Code of Civil Procedure Act.
  • Deregulation of certain professions.
  • Arrangement and liquidation of some criminal regulations that hedged pursuit of business activity around.

 

Disadvantages:

  • The Amendment to the code of civil procedure eliminating any separate proceedings in commercial cases.

 

 

ENACTMENT

Advantages:

  • None.

 

Disadvantages:

  • Damage of regulations of the Public Procurement Law.
  • Lack of consultation on the introduction of a single European patent.
  • The tightening of regulations in the law of competition.

 

 

HEALTH CARE

Advantages:

  • None.

 

Disadvantages:

  • Lack of action and bills or even guidelines to them.
  • Reactionary action rather than long-term planning.
  • Lack of opportunities for dialogue with the Minister of Health.

 

 

LABOUR  LAW

Advantages:

  • Presentation, by MPiPS (Ministry of Labour and Social Policy), of the draft amendment to the labour code provisions on working time.

 

Disadvantages:

  • Lack of legislative initiatives concerning telecommuting.
  • Lack of legislative initiatives concerning collective labour law

 

 

FIGHT AGAINST UNEMPLOYMENT

Advantages:

  • The initiation of a pilot program, "Your career, your choice."
  • The increase and enfranchisement of the retirement age.
  • Development and implementation of the governmental program for the social activity of the elderly (ASOS) for the period of 2012-2013.
  • Poland’s ratification of the UN Convention on the rights of the disabled.

 

Disadvantages:

  • Incompetence and inefficiency of state employment offices.
  • Inefficient and very limited use of funds from the Labour Fund.

 

 

PRO-FAMILY POLICY

Advantages:

  • Increase in funding for nurseries and kindergartens.
  • Extending the directory of persons entitled to post-maternity leave

 

Disadvantages:

  • Plans for extension of leaves connected with the care of a small child.
