In Poland there is neither an internet portal nor an institution for employers responsible for monitoring the legislation process of regulations that determine the rules for business activity. At present employers  learn about changes in the law mainly from mass media or simply through the grapevine, usually with delay.

The proposed amendments to the bankruptcy law go in the right direction

The Ministry of Justice along with the Ministry of Economy have drafted a Bill on Restructuring Law.

 

The main principles of the project include among others shortening the bankruptcy proceedings and reducing their cost, as well as increasing possibilities of satisfying the creditors. The privileged position of the creditors under public law is supposed to be limited.

 

Above all, entrepreneurs care about the liquidation of the privileges of the creditors under public law. – In the current legal status, the taxes and other public levies imposed on a bankrupt charge de facto general creditors. Such practices raise doubts as to their conformity with the Constitution, and do not provide protection for entrepreneurship – says Jacek Cieplak, an expert of the Employers of Poland.
