– Temporary detention or freezing bank accounts are the most onerous preventive measures. Unfortunately, also the most commonly used by the judiciary – Jacek Cieplak, expert of the Employers of Poland points out.
In Poland such repressive measures as detention or freezing bank accounts are regularly used in breach of the principle of proportionality. In case of employers they have far-reaching consequences and cause problems with managing the enterprise or even loss of liquidity.
Using the harshest possible preventive measures often leads to bankruptcy of the company. This is also true in cases where the suspect's guilt is not proven yet and often there is even no prima facie evidence of a tort.
