Legislation Monitoring Centre
In Poland there is neither an internet portal nor an institution for employers responsible for monitoring the legislation process of regulations that determine the rules for business activity. At present employers  learn about changes in the law mainly from mass media or simply through the grapevine, usually with delay.



Multiple fees for the same content are not acceptable


–  Other suggestions of the Collective Management Organizations - ZAiKS, ZPAV and SAWP – on imposing additional charges on smart-phones and tablets are not justified –  says Arkadiusz Pączka, Director of the Legislation Monitoring Centre of the Employers of Poland.


Collective Management Organizations (CMOs) at times suggest extending the so-called list of clean vehicles, i.e. devices that can be used to copy music, pointing to smart-phones and tablets. However, these devices are in principle not used to copy music but to play it from the Internet. Therefore, the question of reprographic fees should be approached with caution.


If those charges were introduces one user would pay several times for the same content, which is unacceptable. This is all the more important as the popularity of websites offering multimedia content for a fee or playing commercials before playing multimedia content is growing dynamically. With this in mind, you should carefully select the devices that will be subject to charges.


Imposing fees for goods not directly related to the storing multimedia content for personal use may curb the development of the electronics and IT sector, and investment in the sectors. Consumers will fell the impact the most as introducing charges will translate directly into higher prices of the devices in question.


Consultations have not brought the expected results in terms of developing a common position of CMOs and business representatives. Therefore, we need further dialogue between all the interested parties and an exchange of real, substantive arguments.
