The seminar entitled „How to prevent conflicts in a company environment? The Entrepreneur Support Centre of Employers of Poland as a systemic proposition for business support” inaugurated the Centre which will a.o. provide free-of-charge legal advice with regards to conflict resolution and mediation.
The event was held at Millenium Plaza in Warsaw City Centre. It was opened by Adviser to the President of Employers of Poland Monika Gładoch who stressed the importance of social dialog for the Organization.
– Particularly now, when we witness many instances of social unrest, dialog is one of our priorities. I am glad that we can meet today – employers, employees, union representatives – and consider the opportunities for supporting entrepreneurs and employees in conflict prevention – stated Monika Gładoch. She also stressed that mediation are the optimum means of resolving social conflicts, including collective disputes. – For example, a procedure before the Commercial Court lasts 540 days, with the execution of the ruling taking a further 140 days – she calculated.
– Only roughly 1 percent of administrative cases concludes in mediation, while the rate of taxation-related cases resolved in this manner is practically zero – added Krystyna Szałkowska-Kozyra PhD, a lawyer specializing a.o. in mediation. In the course of her lecture, she presented detailed calculations which clearly showed that resolving conflicts through mediation, without bringing a case to court, has many benefits – mainly, but not exclusively, financial. – Entrepreneurs conduct economic activities at their own risk, their own responsibility and for profit. Mediation has many advantages compared to court proceedings, The cost of a court case with the value of the conflict of 200 thousand euro is five times higher than the cost of mediation – she explained.
Jacek Męcina, Secretary o State in the Ministry of Labour and Social Policy, congratulated Employers of Poland on this initiative. The Ministry also considers mediation to be the most desirable means of conflict resolution. – The effectiveness of courts is an obstacle for economic activity – he added. He also presented the Ministry’s plans regarding a.o. the Trade Union Act or group dispute resolution.
