Legislation Monitoring Centre
In Poland there is neither an internet portal nor an institution for employers responsible for monitoring the legislation process of regulations that determine the rules for business activity. At present employers  learn about changes in the law mainly from mass media or simply through the grapevine, usually with delay.



Unions are glaringly violating the law. Their strike is illegal


Employers of Poland, The Individual Investors’ Association and the Stock Issuers’ Association put forward a case for the Regional Prosecutors Office to initiate proceedings with regards to eight union leaders active in Jastrzębska Spółka Węglowa and to adapt their actions to legal regulations currently in force.


Union leaders violated not only the act on group disagreement resolution and the Trade Union Act, but also international law (art. 8 of ILO convention no. 87). The object of the disagreement was the issue of change regarding prophylactic meals for employee working above ground and in administration. The JSW board withdrew these changes, so the object of disagreement expired. In spite of that, a referendum was illegally announced which resulted in a strike.


– The strike is illegal. Demands articulated in its course, including the demand for the Board to be dismissed, are completely out of the competence of the union. There are no regulations granting unions the right to decide on the personnel of company organs, including public companies. In a state governed by the law, only competent organs decide on the composition of the board ­– in the case of JSW the Supervisory Board is such an organ.
