Legislation Monitoring Centre
In Poland there is neither an internet portal nor an institution for employers responsible for monitoring the legislation process of regulations that determine the rules for business activity. At present employers  learn about changes in the law mainly from mass media or simply through the grapevine, usually with delay.



Another fruitful meeting of the Financial Platform



The functioning of the Tax Law Consultation Council and the responsibility of board members for tax obligations were the main issues raised at yet another meeting of the Financial platform and the Tax Committee of Employers of Poland.


Mariusz Korzeb – tax adviser, member of the Tax Comitteee of Employers of Poland and the newly established Tax Law Consultation Council, presented the aims of the Council.  – The task of the Council is to advise the ministers in all areas of their responsibility. It is a forum for discussion on problems in the field of tax law – he said.


The issue of board members’ responsibility for companies’ tax obligations was discussed by taxation specialist Agata Czerniak and solicitor Jakub Trębicki. Articles 116 and 118 of the Tax Ordinance are known to be particularly problematic. – It would be worthwhile to amend these regulations so that the responsibility of board members can only be considered with regards to their knowledge of the company’s assets on the last day on their post –­ said Jakub Trębicki.


Apart from that, tax planning was discussed. Tax adviser Przemysław Szabat emphasized that tax regulations currently in force do not establish any limits of legally permitted tax planning.


The Financial Platform associates the biggest companies and institutions on the Polish financial market. Its meeting are attended by representatives of banks, insurance and consulting companies, as well as industry institutions and associations. It is chaired by Iwona Sroka, Vicepresident of Employers of Poland, Chairwomen of KDPW (Central Securities Depository of Poland).
